An agreed motion for the plaintiff’s withdrawal from a class action certification motion against Menora Mivtachim Insurance was recently filed with the District Court. The class action motion concerns payments of insurance benefits on a partial basis for the part of the month in which an insured in long-term care insurance passed away. Within the framework of the withdrawal motion, it was agreed that Menora will complete payment to a full month for the heirs of insureds who received long-term care insurance benefits up to the date of death. In relation to insureds who received long-term care insurance benefits for a full month, and from whom a refund was demanded in relation to the period from the date of death until the end of the month of death, Menora will return to the insureds the payment paid by them. The class action certification motion was filed in March 2026, claiming that Menora demands a refund of insurance benefits for the proportional part of the month in which an insured in long-term care insurance passed away. It was claimed in the motion that Menora’s demand for a refund of long-term care insurance fees is based on the wording of the 2025 policy, even if the insurance event occurred prior to the year 2025 and is subject to a policy wording that did not permit receiving a refund for the month of death. The applicants claimed that they were required to return 2,400 Shekels to Menora because, according to the company’s claim, under the terms of the policy long-term care benefits are paid up to the date of the insured’s death. According to them, Menora relied on a policy provision from 2025, while their mother, who was insured with Menora, was recognized as requiring long-term care as early as 2024. According to them, the fact that Menora changed the wording of the relevant clause and determined that its liability for insurance benefits would end as of the date of the insured’s death indicates that in the policy under which their mother was insured, the right to benefits is for the entire month of death. The claimed damage was estimated at the time of filing the motion at approximately 16 million Shekels for 5,000 people. The parties left the ruling on attorney fees and the applicant’s award to the court’s decision.
