An application for approval of a claim as a class action was submitted to the Magistrate’s Court in Beit She’an, claiming that Menora Mivtachim does not pay benefits to insureds and third parties in cases of revocation of the insured driver’s license. According to a report by Menora, it is alleged in the application that Menora breaches the provisions of the policy and evades paying insurance benefits or compensation to insureds and third parties. It is alleged that Menora removes insurance coverage and does not compensate insureds and third parties in cases of revocation of the driver’s license of the driver of the insured vehicle; or the lack of depositing the driver’s driving license according to the allotted period; or non-completion of a defensive driving course by that driver, and thereby the suspension of their license. The amount of the personal claim was set at a total of 3,540 Shekels. The applicant notes that the amount of the class action is estimated at a total of 2.430 million Shekels. The represented group includes anyone who submitted a claim to Menora for insurance benefits and/or tort compensation, whether it concerns an insured or whether it concerns an injured party, and Menora removed insurance coverage due to the driving license matter of the driver of the vehicle insured with it. This, starting seven years prior to the filing of this application and up to the filing of the application for approval. The main causes of action according to the application are, among others, unjust enrichment, negligence, breach of statutory duty, and breach of the duty to act in an acceptable manner and in good faith in the fulfillment of a contract. The main remedies sought by the applicant are, among others, ordering the respondent to pay the group members full compensation for the accident damages (whether it concerns insurance benefits or whether it concerns tort compensation), plus linkage differentials and interest. Menora reported that at this stage the company is studying the claim and the application.
